Secret Peeping

The North Carolina State Bar has filed a complaint alleging that an attorney engaged in ethical misconduct as a consequence of his guilty plea to the criminal offense of “secret peeping.”

A Raleigh-based attorney charged with felony secret peeping last week was arrested early Tuesday morning with a new charge of indecent liberties with a child. Timothy Lyons, 31, is in jail with no bond. The arrest warrant accuses Lyons of attempting to “take immoral, improper and indecent liberties” with a child.

An arrest warrant from last week accused Timothy Lyons of “secretly or surreptitiously” using an iPod “to create a photographic image” of a juvenile “underneath or through the person’s clothing for the purpose of viewing the person’s body or undergarments and without the person’s consent.” Cary police said Lyons came to the police station last Wednesday night on his own free will and asked to speak to an officer. A spokesperson for Cary police said Lyons was taken into custody and charged after speaking with an officer.

At the time, Lyons was given a $5,000 bond and ordered to have no contact with the victim referenced in the arrest warrant. Also, the judge Thursday told Lyons to have no contact with anyone younger than the age of 18. According to Cary police, Lyons told officers he did not touch or harm any young people, which is reflected on the arrest warrant. He also had no prior criminal history. In court, the assistant district attorney said in an interview that Lyons admitted to taking videos and pictures.
