Sex Assault Conviction Leads To Suspension Of Former Prosecutor

The Presiding Disciplinary Judge approved the parties’ stipulation to discipline and suspended David George McConkie (attorney registration number 39864) for three years. To be reinstated to the practice of law, McConkie must prove by clear and convincing evidence that he has been rehabilitated, has complied with all disciplinary orders and rules, and is fit to practice law. McConkie’s suspension took effect on August 7, 2025.

On April 4, 2025, McConkie signed a plea agreement and pleaded guilty to the charge of criminal attempt to commit sexual assault on a child, a class-five felony. Respondent, who was a deputy district attorney in the Fourth Judicial District from 2008 to 2011, was sentenced to five years of supervised sex offender intensive probation with conditions and the possibility of early termination.

Through this misconduct, McConkie violated Colo. RPC 8.4(b) (it is professional misconduct for a lawyer to commit a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects).

With his sentence, McConkie will be expected to attend therapy treatments, which he and his legal team say have already been ongoing in Utah since May. The sentence also requires him to register as a sex offender within five days of sentencing. He is prohibited him from interacting with anyone under 18 years old with the exception of his biological children.

The victim in the case, who 11 News is choosing not to identify due to the sensitive nature of the incident, spoke remotely in the courtroom at the hearing. She said her priority in the case has always been McConkie’s admission of guilt.

McConkie, who has been living in Utah, also made statements in the courtroom ahead of the sentence being handed down, acknowledging the harm done to the victim and his responsibility for it.

In his statements, McConkie expressed a desire to move forward and improve himself. The judge said she believed he was earnest in his attempts so far to do so.

Judge Sokol told the courtroom that ahead of the hearing, she was still unsure whether or not she was going to assign prison time despite its absence in the plea agreement. After hearing McConkie’s statements, she delivered a sentence with no prison time.

The judge also said McConkie’s ability to practice law has been revoked. According to the Colorado Office of Attorney Regulation Counsel, his license has been suspended since this May.

Prison time can still be imposed if McConkie does not meet the conditions of his probation, the judge said.

McConkie can also appeal to have his probation ended early if he does meet the conditions. The judge said she would not expect that to be granted unless at least half of his sentence has been served.

David McConkie, the former president of the Colorado Springs East Stake within The Church of Jesus Christ of Latter-day Saints, appeared calm, but emotional at times, during his sentencing hearing. McConkie now resides in Utah.
