Texts Draw Charges
A Petition for Discipline has been filed by the Pennsylvania Office of Disciplinary Counsel allegingÂ
Between 2013 and 2024, Respondent represented K.L. in various criminal matters, including those in which she was charged with:
a. theft and receiving stolen property;
b. driving under the influence, child endangerment, and related offenses; and
c. conspiracy to endanger the welfare of a child, conspiracy to commit aggravated assault, and a related Child and Youth Services matter.
Between 2013 and 2014, Respondent’s representation of K.L was in his role as Assistant Public Defender for Montour County; since 2014, Respondent has been either court-appointed or represented K.L. on a pro bono basis.
The petition alleges that K.L. was a vulnerable client
During the representation, Respondent made comments to K.L. regarding her physical appearance, and specifically her breasts and buttocks.
Between November 2023 and February 2024, Respondent communicated with K.L. via text message.
Text messages are appended to the petition
Respondent sent the suggestive and sexually explicit text messages K.L. in an attempt to elicit an intimate sexual relationship with her.
Respondent allegedly was aware that the conduct was improper
Respondent encouraged K.L. to delete his sexually explicit text messages in an attempt to conceal his misconduct and avoid professional discipline.
