A hearing is scheduled on disciplinary charges  before the Ohio Board of Professional Conduct on August 27

A jail visit led to a problem

Before proceeding through the body scanning unit, respondent removed personal items from his pocket and placed them into a tray at the security checkpoint.

Immediately upon placing the items in the tray, respondent removed a baggie containing an unknown white  substance from the tray, clenched the item in his fist, and proceeded to enter the restroom in the atrium area of the Justice Center.

Officer Tina Franks observed respondent remove the baggie from the tray; consequently, she followed respondent to the men’s restroom.

Respondent remained in the men’s restroom for approximately 30 seconds. He then left the restroom and entered the Justice Center Jail Access area, proceeded through the body scanner, and entered the jail.

While respondent was visiting with his client in the jail, Deputy Keith Brosky searched the restroom in the atrium.

Upon entering the restroom, Deputy Brosky noticed that the trash can had been moved away from the wall. Deputy Brosky lifted the trash can and noticed a baggie containing an unknown white substance on the ground.

Deputy Brosky alerted a detective, who, with the assistance of the K9 Unit, identified the white substance as a narcotic.

Upon learning of these events, Sergeant Brian Kaminski of the Cuyahoga County Sheriff’s Department instructed another sergeant to terminate the visit between respondent and his client.

He advised authorities that the drugs were for his personal use; his cell phone was seized and examined

The examination revealed two images containing illegal child abuse material—a photo of a minor with her breasts and genitals exposed and an eight second video depicting the same minor exposing her breasts, genitals, and buttocks.

Criminal charges were brought

During the November 27, 2023 plea hearing, Judge Collier-Williams granted respondent’s Motion for Intervention in Lieu of Conviction, stayed the proceedings, and placed respondent under the control of the Cuyahoga County Probation Department for one year [with conditions]
