Sanctions Proposed In Ohio

The Ohio Board on Professional Conduct has filed several reports recommending discipline of attorneys.

One involves an assistant city prosecutor who used his access to the Ohio Law Enforcement Gateway, which shares criminal justice information, to find information about a person he believed had connected with his wife on a dating application.

He obtained information about the person, sent him text messages and contacted his parents.

He initially denied the conduct but eventually pled guilty to a misdemeanor unauthorized use of property.

The board proposes a fully-stayed two-year suspension in Disciplinary Counsel v. Burkett.

In an unrelated matter, a then officer in the Judge Advocate General Corps was convicted of several offenses relating to an incident of assault and domestic violence.

He has been suspended on an interim basis since March 2023.

The board recommends a two-year suspension with credit for time served in Disciplinary Counsel v. McClain.  (Mike Frisch)
