In our earlier reasons, we accepted the expert evidence of Dr. Andrew Morgan, who diagnosed the Lawyer with a delusional disorder, persecutory type. The Lawyer believes that individuals and the Canadian government are attempting to monitor him surreptitiously and recruit him into CSIS to work for the security apparatus. The Lawyer has commenced a number of proceedings in Federal Court on this basis and has engaged in conduct in those proceedings that compromised the integrity of the justice system and that, if allowed, would bring the administration of justice into dispute. This was the basis of our conclusion that the Lawyer was and is incapacitated.
