Persistence Did Not Pay
The Massachusetts Supreme Judicial Court imposed an 18-month suspension of an attorney.

After losing an eviction case in the Framingham District Court, the respondent attempted to relitigate the eviction and related matters in the Superior Court, Probate Court, Small Claims Court, Bankruptcy Court, U.S. District Court and U.S. Court of Appeals for the First Circuit. He lost repeatedly, but continued to press the legal points he had unsuccessfully pursued. He did not cease his endeavors after his client terminated the representation.
Justice Lowy adopted the proposed discipline of the board
There were no mitigating factors. In aggravation, the respondent was found to be an experienced lawyer who had violated numerous disciplinary rules concurrently, and caused harm to his client and third-parties. He lacked insight into or appreciation of his basic ethical obligations, and refused to acknowledge the nature, effects, or implications of his misconduct. Most significant, he had been disciplined before for nearly identical misconduct.
