Lost Weekend

A recent 30 day suspension by consent was accepted by the Iowa Supreme Court for sex with a client.

The affidavit avers that the attorney had been appointed to represent a client charged with operating a vehicle while intoxicated.

A motion to suppress was granted and the client was set to plead guilty to careless driving on a Monday.

That weekend, the attorney was home and drinking when he and the client connected on Facebook.

At my home, my client and I began to engage in intimate relations. The encounter ended when my wife discovered us partially unclothed in the basement. Because of my intoxication, my memory of the incident is not clear; however, it is my understanding that sexual intercourse had not yet occurred. I acknowledge that had my wife not discovered us, this encounter likely would have ended in sexual intercourse.

The attorney filed a motion to withdraw from the case on Saturday morning; the motion was granted on Monday.

The client entered the plea to careless driving, without the assistance of counsel.

The affidavit further states that the attorney had been drinking heavily, that he had sought treatment and that the incident ended his marriage. (Mike Frisch)
