A Silly Exercise?
An unusual bar disciplinary matter argued last week before the Kansas Supreme Court elicited questions from the bench over whether the entire affair was the product of an “over litigious” society.
The matter was presented to the court as a consent disposition for a stayed 90-day suspension with probation.
One of the questions (perhaps a paraphrase) asked whether this was
a silly exercise over a busted tail light
Respondent was returning a golf cart after playing a round of golf with his mother. He caused some damage to the cart and a truck he had bumped into and did not immediately report the damage.
The underlying matter was quickly resolved with a citation plea and payment of the damages.
Having seen the argument twice now, I predict that the court will reject the consent disposition and remand the matter for either a lesser or no sanction. (Mike Frisch)
