After thorough consideration of the record and governing law, the court dismisses two of
the charged counts, concluding Respondent’s conduct at issue therein is protected by the First
Amendment. The remaining two counts involve conduct the court determines is not
constitutionally protected and are supported by clear and convincing evidence.
