The British Columbia Law Society concluded that an attorney made improper closing argument to the jury in a personal injury matter resulting in a mistrial.

Dr. AT gave evidence at trial and was cross-examined by the Respondent. During the course of cross-examination, the Respondent attempted to reenact a Johnny Carson sketch known as “Carnac the Magnificent”. In the Carnac sketches, Johnny Carson played a mystic who would provide answers to questions in sealed envelopes. The punchline of the joke occurred when Johnny Carson opened the envelope to read the question to which he had already provided the answer. The Respondent’s reenactment was successfully objected to.
