Suspended For Now
The Law Society of Upper Canada Tribunal Hearing Division imposed an interlocutory suspension of a paralegal facing criminal charges
Mr. Hildyard attended today and requested an adjournment on the basis that he’s just received disclosure from the Crown with respect to his criminal charges and that he wishes to have counsel review the disclosure to see whether any evidence in it relates to the issues on this interlocutory suspension motion. The Law Society opposes the adjournment and submits that if any adjournment is to be granted, then an interim interlocutory suspension should be imposed to protect the public interest in the meantime.
We agree with the Law Society. We are prepared to grant the adjournment as a matter of procedural fairness but find that an interim interlocutory suspension is appropriate pending the full hearing of this interlocutory suspension motion. Accordingly, we grant the adjournment on the condition that the Licensee is suspended on an interim interlocutory basis until the hearing of the full motion and subject to the conditions of such an interim interlocutory suspension.
Costs of today will be left to the hearing panel hearing the full motion. The Tribunal is requested to reschedule the interlocutory suspension motion hearing for a date not later than March 29, 2019. This panel orders the hearing is adjourned to a date to be set by the scheduling coordinator and finalized no later than March 29, 2019.
The respondent is suspended on an interim interlocutory basis commencing immediately and continuing until the panel’s decision on the merits of the interlocutory suspension motion. The respondent shall fully comply with the Guidelines for Paralegals Who are Suspended or Who Have Given an Undertaking Not to Provide Legal Services while suspended pursuant to this order. Costs of today will be dealt with together with costs of the motion
