Too Late To Postpone

A continuance motion was denied by the Upper Canada Law Society Hearing Division Tribunal

The Lawyer sought an adjournment, without notice, on the day of his conduct hearing on the basis that he had been caring for his ill mother and had a lawyer who could represent him but was unavailable that day – Motion dismissed – The Lawyer had been aware of the hearing date for two-and-a-half-months and did not contact the Tribunal or the Society about any potential issues or file any material – The conduct application arose from nine separate investigations, some of which were three years old, and the Lawyer’s mother’s condition, while unfortunate, had been longstanding and was the basis for several extensions afforded to the Lawyer to provide information sought in 29 written requests, which remained unanswered – A last-minute adjournment was not warranted in these circumstances.
