The Presiding Disciplinary Judge approved the parties’ conditional admission of misconduct in this reciprocal discipline matter and suspended Richard Randall Kuritz (attorney registration number 26499) for ninety-one days, effective March 14, 2017. Kuritz’s reinstatement in Colorado is conditioned on his reinstatement from his suspension in Florida.
On January 25, 2007, the Florida Supreme Court publicly reprimanded Kuritz, but he failed to report the reprimand to Colorado disciplinary authorities, as he was required to do. On August 25, 2016, the Florida Supreme Court suspended Kuritz from the practice of law for ninety-one days. That suspension was based on his actions while representing a defendant in a death penalty case.
Kuritz violated three Florida rules, including those governing candor toward the tribunal and communication with jurors. Kuritz’s misconduct constitutes grounds for reciprocal discipline under C.R.C.P. 251.5 and 251.21, which calls for imposition of the same discipline as that imposed in Florida.
News4Jax reported on the Florida discipline matter
Well-known Jacksonville defense lawyer Richard Kuritz was suspended for 91-days by the Florida Bar Association for misconduct in the appeal of the murder conviction of Rasheem Dubose.
Dubose was convicted of first-degree murder in 2010 in the death of 8-year-old Dreshawna Davis. Dubose and his two brothers fired 29 shots into the Northwest Jacksonville home of Dreshawna’s grandparents in July 2006, killing the girl.
Dubose was sentenced to death, and his brothers were each sentenced to life in prison.
After Dubose’s conviction in 2010, one of the jurors approached Kuritz and said she’d been bullied into convicting Dubose by other jurors who’d used their cellphones to investigate the case.
There was a hearing on her allegations, which were found to be not credible.
The bar’s discipline committee cited Kuritz for failing to disclose that he had spoken to that juror regarding traffic citations and a civil suit while the Dubose appeal was pending.
Kuritz maintains he did disclose the contact up-front.
