Suspension For Sex With Client
From the web page of the North Carolina State Bar
[An attorney] of Sanford engaged in sexual intercourse with his current client and engaged in a conflict of interest by continuing or resuming the representation. The DHC suspended [him] for three years. After serving 18 months active suspension, [He] will be eligible to petition for a stay of the balance upon showing compliance with numerous conditions.
The discipline was imposed by consent.
The order notes that the representation began in 2009 and involved a separation agreement. The sexual relationship did not commence until several years later.
The attorney withdrew from the representation but the client was later represented by his law partner. He continued to both advise and have sex with the client during the resumed attorney-client relationship with his law firm. (Mike Frisch)
