Persuasive Powers
The North Carolina State Bar has filed a complaint alleging misconduct on the part of a Chapel Hill attorney.
The complaint alleges that the attorney (at the time married) had an intimate relationship with a man named Tom Powers (also married at the time).
When Mrs. Powers sued for divorce on grounds of adultery, Mr. Powers responded that he had been a “faithful and dutiful” husband and had not engaged in marital misconduct.
Mrs. Powers noticed the attorney’s deposition.
The charges allege that the attorney (at the urging of Mr, Powers) falsely denied the relationship at the deposition in a number of particulars.
When Mr. Powers’ ex-wife sued the attorney for alienation of affections and criminal conversation, it is alleged that the false denials were repeated in that litigation. (Mike Frisch)
