After The Fire

The North Carolina State Bar has filed a complaint alleging that a Mocksville attorney had delegated trust account obligations to non-lawyer assistants and failed to train them in the ethical obligations that a lawyer has in accounting for entrusted funds.

Alll went well (or at least went undetected) until the attorney received notice of a random audit.

Then, it is alleged

On 3 January 2012, the night before the scheduled audit, someone set fire to [the attorney’s] office…the results of the insurance investigation suggested that the fire was intentionally set.

The charges are based on the post-fire reconstruction of the account.

He is not charged with arson.
