An attorney found to have engaged in misconduct received a recommendation of a one-year suspension by a hearing panel subcommittee of the West Virginia State Bar,

The Office of Disciplinary Counsel sought review and advocated in favor a double that – a two-year suspension.

The West Virginia Supreme Court of Appeals agreed with neither position and had the deciding vote.

The verdict was a three-year suspension.
