In-House Counsel: Illinois Forgives Unauthorized Practice

The Illinois Supreme Court issued an order last November granting amnesty to in-house counsel who are in violation of the licensing requirements of its rules.

An attorney who is obligated to register must make application under Rule 716 and meet all requirements for licensing under that Rule, pay any arrearages and make up any CLE credits.

Further, the order provides that attorneys who get amnesty “shall not be prosecuted for unauthorized practice of law” and their co-employees will not be subject to investigation for any failure to report the unauthorized practice. (Mike Frisch)
