The District of Columbia Office of Bar Counsel has informally admonished a Bingham McCutchen partner for a conflict of interest while representing a client, International Power America(“IPA”) , in a variety of legal matters.
The director of business development for IPA decided to form his own solar energy projects company. As a result, his work for IPA suffered. An investigation revealed e-mails about the new company, to which the attorney provided legal services to the new company. IPA complained to Bar Counsel.
Bar counsel determined that the representation created a conflict of interest with IPA, a current client, and that the attorney made no effort to obtain informed consent.
