No Summary Judgment In Suit Against Fen/Pfen Attorney
The Mississippi Supreme Court has concluded that partial summary judgment was improperly granted to an attorney sued by former clients who he had represented in diet drug litigation. The former clients had sought to pay on a quantum meruit basis rather than under a claimed 45% contingent fee. The court here held that questions about the authenticity of the contingent fee agreement and possible coercion created jury questions that precluded summary judgment. (Mike Frisch)
