“Shocking Disregard”
The New York Appellate Division for the First Judicial Department ordered the interim suspension for an attorney who had failed to cooperate with an investigation into two complaints alleging possible misuse of entrusted funds:
The Committee’s motion for an interim suspension should be grantedsince respondent’s failure to comply with the Committee’s lawfulrequest for documentation, to respond to its subpoena and to answer thesecond complaint evinces a shocking disregard for the judicial systemwhich can only be interpreted as a deliberate and wilful attempt toimpede the Committee’s investigation. Accordingly, suspension pursuantto 22 NYCRR 603.4(e)(1)(i) is warranted.
