Contempt Reversed And Remanded

A civil contempt fine that had been imposed on an attorney for failure to appear in a probate matter was reversed by the Florida Fifth District Court of Appeal. The fine had been imposed without notice or opportunity to defend in violation of the lawyer’s due process rights. On remand, the trial court may impose sanctions after a proceeding in compliance with the dictates of the court’s opinion. (Mike Frisch)
