The Michigan Attorney Discipline Board has vacated an interim suspension.
In accordance with MCR 9.120(8)(1), the Attorney Discipline 80ard must set aside an attorney’s automatic suspension upon conviction of a felony if that conviction is subsequently vacated, reversed, or otherwise set aside by an appellate court. The respondent filed a Motion to Set Aside Automatic Suspension of law License Pursuant to MCR 9.120(8)(1), based upon the December 12, 2018 Order entered in the above-referenced Macomb County Circuit Court case reversing respondent’s felony conviction for assault/resist/obstructing of a police officer, in violation of MCL 750.81 D(1) and granting the motion for a new trial. The Court denied respondent’s motion as to the misdemeanor conviction for assault, in violation of MCl 750.81.
In accordance with the Court Rule, proceedings against respondent under MCR 9.120(8) are dismissed and the automatic interim suspension, effective May 2, 2018, is vacated.

A Macomb County defense attorney will stand trial after he was accused of punching a Roseville police officer during a confrontation in Roseville district court in March.
Nijad Mehanna of Roseville was bound over to Macomb County Circuit Court on charges of assaulting, resisting, obstructing a police officer — a two-year felony — and misdemeanor assault during a preliminary exam Wednesday in 41-B District Court in Clinton Township, Assistant Prosecutor Joshua Van Laan said.

The chief judge in Roseville district court ultimately decided the case should be handled elsewhere, and the State Court Administrative Office assigned it to Judge Linda Davis at the district court in Clinton Township, Van Laan said.
Roseville police had said that in March, Mehanna was in 39th District Court in Roseville representing someone in a drug case when he had words with the detective lieutenant in charge of the case over his access to a codefendant of his client.
The two exchanged insults when, witnesses in the courtroom said, Mehanna walked up to the officer, pushed him in the chest and tried to push past him into a restricted office area, police previously said.
They said when Mehanna found his way blocked into the office area, he struck the officer in the face with his fist. Then, police said, Mehanna threw several more punches before being wrestled to the ground by the officer and district court officers.
The officer sustained several loose teeth, a swollen lip and a bloody nose from the attack, police said. Mehanna was not injured.
Mehanna was taken into custody. He is listed as an attorney in active and good standing, according to the State Bar of Michigan website, which lists him as being admitted in November 2000.
