Burden Of Proof In Contempt Of Disciplinary Order

The Maine Supreme Judicial Court affirmed a contempt finding against an attorney for violation of a prior disciplinary order. The court rejected the contention that the burden of proof in such a proceeding was beyond a reasonable doubt. As attorney discipline is “regulatory in nature,” the burden is the lesser standard of clear and convincing evidence. (Mike Frisch)
