Dispensing Discipline
The Colorado Presiding Disciplinary Judge approved a conditional admission of misconduct of an attorney for misconduct in the course of representing a medical marijuana dispensary.
The client could not obtain a license and operate due to a pending tax lien. The attorney applied for the license in his own name and was granted it to operate the dispensary.
After a police search of the dispensary premises, the attorney was charged with felonies. He pleaded guilty to misdemeanor possession of marijuana.
The sanction is a one-year suspension with all but 60 days stayed and a one-year period of probation with conditions. (Mike Frisch)
